General terms and conditions of the company HopeCosmetics
I. Scope
(1) The following General Terms and Conditions ("GTC") apply between the company HopeCosmetics, owner: Sh`ree Fruth ("HopeCosmetics"), and its customers for all services in the field of caring and decorative cosmetic treatments and massages, which are carried out at the location of our DaySpa 's at Hohenzollernstraße 29 in 90475 Nuremberg & An der Fleischbrücke 1-3 90403 Nuremberg (see Section II.) and for all consumer orders in the web shop at the URL https://www.hopecosmetics.de/shop/ (see section III.) in the version valid at the time of the treatment/order.
(2) HopeCosmetics reserves the right to change these terms and conditions at any time. Any regulations that deviate from these General Terms and Conditions only apply if they have been confirmed by HopeCosmetics in text form.
II. Treatments in the DaySpa
1. Conclusion of Contract
(1) By arranging an appointment for one of HopeCosmetics' services, the customer bindingly declares acceptance of our contract offer. If the contract is concluded electronically, receipt of the booking will be confirmed. The confirmation of receipt does not yet represent a binding acceptance of the booking. The binding acceptance of the booking takes place with our written or telephone confirmation of the appointment.
(2) Our offers are non-binding. Changes remain reserved within Reasonable limits. All prices for the execution of the services are based on the current price lists, which are available for inspection at the place of business or can be called up on the Internet. All prices quoted include the legally applicable sales tax. The prices are due for payment immediately after completion of the treatment and without any discount at the place of business in cash or by EC card.
(3) A late arrival at the agreed appointment may also be deducted from the treatment time in the interest of the following customers. No price reductions can be granted for a reduction in treatment requested by the customer during the appointment. The full treatment price according to the booking must be paid. Appointment cancellations/postponements must be received by us twelve hours in advance, otherwise a cancellation fee of 60% of the price of the treatment agreed in advance will be charged. If appointments are missed, 100% of the booked appointment will be charged. The customer is expressly permitted to prove that no damage or depreciation has occurred at all or is significantly lower than the flat rate.
2. Liability
(1) The customer is obliged to inform us before the start of treatment about existing clinical pictures or allergies that prevent treatment. If the customer fails to provide such information, we assume no liability for possible consequential damage.
(2) HopeCosmetics is liable without limitation if the cause of the damage is based on intent or gross negligence. HopeCosmetics is liable for the slightly negligent breach of essential obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for the breach of obligations, the fulfillment of which is essential for the proper execution of the contract and on the observance of which you regularly rely. In this case, however, HopeCosmetics is only liable for the foreseeable, contract-typical damage. HopeCosmetics is not liable for the slightly negligent breach of obligations other than those specified in the preceding sentences. The above limitations of liability do not apply in the case of culpable injury to life, body and health, in the case of the assumption of a guarantee for the quality of the product and in the case of fraudulently concealed defects.
(3) Insofar as HopeCosmetics' liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.
(4) HopeCosmetics assumes no liability for valuables that are carried by the customer or forgotten in the company.
3. Gift Certificates
(1) Gift vouchers are vouchers for a specific value that you can purchase from HopeCosmetics and redeem to pay for HopeCosmetics services in the DaySpa. Redemption from other third parties is not possible.
(2) Gift vouchers are valid for three years. This period begins on the date of issue. The commercial resale of gift vouchers is not permitted; Otherwise, gift vouchers are transferrable. The value of a gift certificate is neither paid out in cash nor does it bear interest.
(3) To redeem a gift voucher, the gift voucher must be presented in the DaySpa prior to the payment process. Subsequent redemption or offsetting of a gift voucher for a completed treatment order or a completed payment process is not possible.
(4) The combination of several gift vouchers is possible. A combination with special offers is not possible.
(5) If the value of a service exceeds the value of the gift voucher, the difference can be paid using the payment options offered.
III. Orders in the web shop
1. Conclusion of Contract
All offers in the HopeCosmetics online shop are subject to change and non-binding. With your order via the "Buy now" button, you make a binding purchase offer that still requires acceptance by HopeCosmetics. This acceptance by HopeCosmetics can be made by sending the shipping confirmation, debiting your credit card or by sending the goods.
2. Prices, delivery, shipping costs
(1) The prices stated in our online shop include the applicable statutory sales tax.
(2) The delivery will be made to the address you have specified, unless you have specified a different delivery address. Deliveries are only possible to addresses within Germany. If not all desired items are in stock, partial deliveries are permitted, provided this is reasonable for you. Subsequent deliveries are postage free for you. 3. Right of withdrawal, exclusion of the right of withdrawal

Consequences of withdrawal
If you revoke this contract, we have paid you all payments that we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We may refuse repayment until we have received the returned goods or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. The return shipment is free for you.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
The right of withdrawal does not apply to the delivery of goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.

4. Payment
(1) You can always pay for your purchase via Paypal, Giro Card, Apple Pay or credit card. With every order, HopeCosmetics reserves the right not to offer certain payment methods and to refer to other payment methods.

5. Liability for Defects, Compensation, Return
